Our Approach to Commercial Disputes
At Lanyon Bowdler, we recognise that businesses have finite resources. With so many calls on your time and money, you need to ensure you invest it wisely. We know that deciding how to deal with a dispute is in many ways an investment decision. We work closely with you from the outset, to assess the likely outcome your case, the likely timescale to resolution, and the cost, so you can decide whether the likely benefit (the return) justifies the time and money involved (the investment). We take time to find out what is important to you and what you want to achieve and use our experience to devise a strategy to help you achieve it. We do not see ‘winning at trial’ as our goal – our aim is always to get the right result as quickly and cost effectively as possible. Our expertise in evaluating legal problems and negotiation skills usually mean that your case will be resolved well before a trial, and often without starting court proceedings at all.
All members of our team have mediation training, and Brian Evans is an accredited mediator. We make good use of mediation and other dispute resolution techniques like adjudication, and arbitration as well as simply talking to your opponent and negotiating. But if the case does need to go to trial, we fight hard to win, and have a good track record in the County Court, the High Court and the Court of Appeal. If that's the case, you know you're in safe hands with Lanyon Bowdler.
Legal 500 Recommendation
The 2010 edition of the Legal 500 comments:
"The 'thorough' Brian Evans acted in a shareholder dispute involving allegations of unfair prejudice, a threatened petition for just and equitable winding up, and an application for rectification of the register of members. He is also noted for his understanding of the 'quirks within the agricultural industry'."
