Who Can Claim Back Care Home Fees?
Deadlines have now passed for reclaiming fees relating to periods of care pre 1 April 2012 unless there are exceptional circumstances. However, people who are currently in care, or the estates of individuals who have passed away since April 2012 who are or were contributing to or paying care home fees in full, may be eligible to make a claim.
Who is Eligible for NHS Care Home Funding?
The NHS is obliged to fund nursing care in full for all patients who have a primary healthcare need irrespective of their financial means. If you are/were sick and in need of long term nursing care either at home or in a residential or nursing home environment, you should have had an assessment by the NHS to see if you were eligible for Continuous Healthcare funding. If you did not have an assessment or you were assessed but disagree with the outcome of the assessment, then you have a right to challenge this.
