WHAT IS A PRE-NUPTIAL AGREEMENT?

A pre-nuptial agreement sets out guidelines for how shared assets should be divided, as well as giving couples the potential to recommend arrangements for things such as child support payments, should the marriage break down.

Although not yet considered legally binding, pre-nuptial agreements are taken into account by UK divorce courts and as such are an effective way of avoiding lengthy legal battles in the future.

DRAFTING A PRE-NUPTIAL AGREEMENT

It can be an extremely complex process to draft a pre-nuptial agreement so employing an experienced family law specialist is a good idea.

Agreements must meet a series of guidelines to be recognised by UK courts:

  • It must not be weighted too much in any one person’s favour, and it needs to be realistic in light of current divorce law precedents.
  • Both parties must produce full financial disclosure prior to the agreement.
  • There must be no pressure applied to either party to enter into the agreement.
  • It is recommended by most family law solicitors that a pre-nuptial agreement should last only until the birth of the first child, or for a period of five years.
  • Independent legal advice must be secured by both parties before entering into the agreement.
