What is Drink Driving?
A motorist is liable to be charged with drink driving if they are found to have driven, or attempted to drive, with more than 35 mg of alcohol per 100 ml of breath, or 80 mg of alcohol per 100 ml of blood, in their body.
Punishments for those found guilty of the offence can include:
- A £5,000 fine
- A six month prison sentence
- 3 - 11 points on the driving licence for 10 years
- Disqualification from driving
- Requirement to sit another, extended driving test
These punishments are severe, but with the help of an expert drink driving law solicitor it is possible that other less strict penalties are handed to the accused.
When Can Police Stop Drivers for Breath Tests?
A police officer can request a breath test from anybody who is driving or in charge of a vehicle on a road or in a public place, so long as they have a reasonable cause to do so.
