What is Conveyancing?
Conveyancing refers to all the legal work involved in the transfer of property from one owner to another. Whilst it is not required by law that a buyer or seller uses a property lawyer to take care of the conveyancing process, it is strongly recommended. Residential conveyancing is an extremely complicated process, and if you are inexperienced it is easy to make mistakes that could have serious repercussions in the future, for instance:
- checking the legal boundaries of any land attached to the property
- if anything goes wrong during the property transfer, you will be personally accountable and may be forced to pay compensation to the other party, as well as their legal costs;
- whether you are selling or buying a home, the other party may be reluctant to complete the transfer if they are uncertain of your conveyancing experience;
- if you are using a lender, you will still have to pay for them to hire a conveyancer (the lender typically agrees to use the same conveyancer as the buyer or seller, in order to save on legal costs).
