WHAT IS CONVEYANCING?

Put simply, conveyancing is the term for all the legal stuff which needs to happen when a property transfers from one person to another.

You are not actually required by law to use a property lawyer to oversee the process, but we would thoroughly recommend it. Conveyancing is a very complicated area, and any mistakes could have serious implications in the future.

Conveyancing refers to all the legal work involved in the transfer of property from one owner to another. Whilst it is not required by law that a buyer or seller uses a property lawyer to take care of the conveyancing process, it is strongly recommended. Residential conveyancing is an extremely complicated process, and if you are inexperienced it is easy to make mistakes that could have serious repercussions in the future, such as:

  • If anything goes wrong during the property transfer, you will be personally accountable and may be forced to pay compensation to the other party, as well as their legal costs.
  • If you are using a lender to finance the purchase, you will still have to pay for them to hire a conveyancer (the lender typically agrees to use the same conveyancer as the buyer or seller, in order to save on legal costs).
  • Whether you are selling or buying a home, the other party may be reluctant to complete the transfer if they are uncertain of your conveyancing experience.

To be honest, there are a host of potential problems if you undertake your own conveyancing, not to mention the added stress and the need to familiarise yourself with the minutiae of the legal process.
