AI – Is It an Alternative to Your Own Words?.

AI powered chatbots are fast becoming an increasingly popular aid in many different areas. Whilst there are undoubtedly benefits to the technology, it begs the question – would you allow artificial intelligence to tell your story?

A clinical negligence case is personal in its very nature. Whether you are enquiring on behalf of yourself or a loved one, there is no doubt that it will be a deeply personal matter.

AI chatbots will often have the capability to analyse a set of facts and set out any perceived failings in care. However, it must be counselled that the advice provided is not always accurate and will often cite legislation that is not relevant or correct. AI generated answers will often be tailored to provide an answer to the information given and this answer may not always be right.

Instead it will tell you what it thinks you want to hear, regardless of any legal inaccuracies. This may create false expectations or hope, when a computer provides an opinion, on whether your case may be successful, or its potential value.

Rest assured there is no need to provide us with a detailed case summary and analysis. Your words are enough.

The first step when making an enquiry to our Clinical Negligence Team is an initial telephone call with a member of the team. Our staff are fully trained to guide you through this call in a supportive and compassionate way. Whilst this may be daunting, what we really need to hear is your own story, in your own words. We want to understand what has happened and what has prompted you to get in touch.

At Lanyon Bowdler we fully believe that the individual should be at the heart of the process.
After that initial call, a team of senior solicitors will consider your enquiry in detail. As clinical negligence specialists, we have the necessary expertise to consider your enquiry, and assess whether we can assist with a potential claim. We have the knowledge and skills to carry out an assessment of your potential claim, and then advise as to its merits or any difficulties, without the need for artificial intelligence.

The pitfalls of AI were highlighted recently when fictitious case law was used in court. In short, there is no substitute for personal knowledge and research underpinned by many years of experience and training.
Whilst it is well known that AI has the capacity to generate text/documents in a human tone, our experience tells us that there is no substitute for a personal account. AI generated text often has hallmark signs, and in many situations the true message and detail is often lost in favour of computer generated analysis.

It is completely understandable that AI is often used in situations where you simply do not feel that you have the words to describe what has happened and equally, there may be situations where AI has pointed you in the direction of making an enquiry. Without a doubt, AI can be a useful tool and may be the first step in your journey. However, it is the human moments and recollections that are often the key to a starting a clinical negligence case.

If you or a loved one have been impacted by substandard medical care, please do reach out to a member of our team who will be happy to assist.

Our awards and accolades.
