How much compensation can I expect for a serious injury claim?

Every Serious Injury Claim is unique. Unique because of the differences that exist between the circumstances, causes and liability surrounding the accident or the act of negligence itself and also unique because every individual is also unique.

For many reasons it is difficult to forecast the exact amount of compensation that may eventually be paid out, but each serious injury claim will be valued based on certain conditions:

  • Loss of earnings suffered by the victim including future projected losses. Any lost earnings suffered by family members who provided / continue to provide care would also be for consideration.
  • Medical costs
  • Costs surrounding any material losses occurring during the accident (ie Motorcycle)
  • Rehabilitation and physical therapy costs
  • Costs of Psychological care / support
  • Costs of home or vehicle adaptations needed to enhance independent living
  • Equipment costs: aids to enhance independent living such as wheelchairs
  • General damages considerate of pain and suffering endured by the victim and their family
Who can make a serious injury claim for compensation?

Unfortunately, it is the case, that on many occasions where a person has sustained the most serious of injuries, it is not possible for that person themselves to pursue a serious injury claim. Rightly this does not prohibit family member from seeking the justice deserved.

If a child has experienced a catastrophic injury, their parents or a legal guardian is entitled to make the claim for compensation. In the case of children, a claim can still be submitted for up to 3 years beyond the child turning 18 years old.

For an adult experiencing a serious injury, then a claim must be brought within 3 years of the incident, although there are exceptional circumstances that surround this time limit based on the mental capacity of the injured person. In the case of an adult a spouse, family member of dependent can make a serious injury claim on behalf of the injured person.

As mentioned, there are exceptions and special circumstances that courts may need to consider surrounding time limits so if you are unsure about anything regarding the potential for you to make a claim for compensation for yourself or for a family member, we will quickly be able to put your mind at ease.
