Delay in diagnosis of cancer podcast

Listen here to Beth Heath and a former colleague from the Clinical Negligence team talk about the delay in diagnosis of Cancer, using fictitious, but typical cases to illustrate the challenges people are facing.

The Legal 500 & Chambers UK recommendations

The Medical Negligence Team is recognised in Tier One for the West Midlands in the 2024 edition of The Legal 500, which states ‘The ‘approachable and collaborative individuals’ at Lanyon Bowdler are praised for the ‘time given to the client to offer reassurance and explanations. It has a vast array of experience in cases involving catastrophic injuries (including birth, brain and spinal injuries, amputations and fatal claims)’.

Chambers UK 2024 rank the department in Band One for the Midlands and states ‘an impressive practice group with a growing presence across the West Midlands. The team offers specialist advice across the full gamut of clinical negligence mandates, with particular experience in cases of surgical error, delayed diagnosis and failure to supervise those at risk of suicide. The firm is additionally skilled in cases relating to post-surgical negligence, brain injury and fatal claims.’

Lanyon Bowdler clinical negligence team win 'Team of The Year' in Personal Injury Awards 2018

Lanyon Bowdler won the Clinical Negligence Team of the Year title at the Eclipse Proclaim Personal Injury Awards in Manchester, beating off competition from across the UK.

Kay Kelly, former head and now consultant for the team, said: “This is absolutely wonderful news and is a fitting tribute to the expertise and dedication of our clinical negligence lawyers.

“Clinical negligence is a particularly sensitive area of law which makes a tremendous difference to people’s lives. A successful claim can be vital for the person’s recovery and future quality of life, so to be recognised as being the best team in the country for our work means a great deal.”

The team is both proud and delighted to have won this award. The winning video submission can be viewed below.

The team were also finalists in the 2022 awards.

Types of Cancer Misdiagnosis Claims

Claims relating to misdiagnosed cancer can include a number of types of cancer, with the most common forms being breast, lung, cervical, ovarian, testicular and prostate cancer.

Misdiagnosis of breast cancer

Breast cancer is the most common form of cancer found in women, and the success rate of any treatment is significantly higher if the condition is discovered early.

If the cancer is missed or misdiagnosed, treatment can be more difficult and the chance of recovery reduced. If you have had test results misinterpreted or something missed during an examination, you could be entitled to breast cancer misdiagnosis compensation.

Misdiagnosis of cervical cancer

Another common form of cancer amongst women is cervical cancer, which is treatable if detected early. Smear tests are crucial in diagnosing cervical cancer, but there have been numerous incidents of inaccurate smears leading to misdiagnosis.

A delay in diagnosis could mean you have grounds for a clinical negligence case, and our specialist medical negligence lawyers can advise you on the best way forward.

You should also seek legal advice if there were concerns about the treatment itself, such as whether enough tissue was removed to effect a cure, or whether unnecessary radical treatment was used which could to fertility problems.

Misdiagnosis of ovarian cancer

The actual cause of ovarian cancer is unknown, but there are some factors which may increase the likelihood of diagnosis, such as:

  • Having a family history of ovarian cancer
  • Using hormone treatments or fertility drugs
  • The risk of ovarian cancer increases as you grow older
  • It is more common in women without children

Like other forms of cancer, early diagnosis is key to treating ovarian cancer, but there are many cases of misdiagnosis. If you think you have been misdiagnosed or not got the treatment you deserved, you could be able to claim compensation.

Misdiagnosis of prostate cancer

Prostate cancer is easily treatable if correctly diagnosed and caught early enough, with more than 90% of cases treated successfully.

However, there are still a small number of cases when medical professionals misdiagnose prostate cancer, and if you have been affected by clinical negligence, please get in touch to see how we can help.
