Trust Solicitors.
When it comes to protecting your family’s future, few decisions carry more weight than how your assets will be managed and passed on.
Whether you’re thinking ahead for young children or grandchildren, safeguarding the interests of a loved one with additional needs, or simply wanting peace of mind that your wishes will be respected, a trust can provide a sense of security that lasts beyond your lifetime. At Lanyon Bowdler, our experienced trust solicitors are here to guide you with warmth, clarity and unwavering professionalism.
Whether you are looking to safeguard your assets, ensure your loved ones are provided for, or manage an inheritance in a thoughtful and tax-efficient way, setting up a trust can offer reassurance, flexibility and control. Trusts are not necessarily just tools for the wealthy, they may also be for those who want to protect what they’ve worked hard to build and pass it on with peace of mind.
Based in Shropshire, Herefordshire and North Wales, our specialist team supports individuals and families at all stages of life. From setting up a trust to protect savings for your children, vulnerable dependents or multiple generations, we take time to understand your goals and offer advice that’s tailored, thorough, and always in your best interests.
We’re here to make the process as smooth as possible, make your wishes clear, and ensure your trust is structured with care and foresight. And if you’re a trustee seeking help with your legal responsibilities, or a beneficiary unsure of your rights, we’re equally well placed to advise and support you.
What is a Trust?
At its heart, a trust is a legal arrangement designed to manage and protect assets, whether that’s money, property, investments, or personal belongings, for the benefit of someone else. You might want to set up a trust to support a beneficiary until they come of age, to protect a vulnerable family member, or to plan for the distribution of your assets in as controlled and tax-efficient way as possible.
Trusts can be created during your lifetime or written into your will to take effect after your death. In either case, they work by placing assets into the care of chosen individuals, known as trustees, who have a legal duty to manage them responsibly on behalf of the beneficiaries.
The person who sets up the trust is known as the settlor. As the settlor, you decide what assets go into the trust, who will benefit from them, and under what circumstances. You can be very specific, such as stating that a grandchild should receive a lump sum when they turn 25, or you can give your trustees discretion to make decisions based on changing needs over time.
There are many different types of trust, each suited to particular goals. Some are simple and straightforward, such as a bare trust set up to hold savings for a young person. Others are more complicated, offering protection against inheritance tax, care fees, or financial risks like divorce or bankruptcy.
While the law around trusts can be detailed, the principle is reassuringly simple: they allow you to plan for the future, support those you care about, and retain control over how your estate is passed on, even when you’re no longer here to manage it yourself.
At Lanyon Bowdler, our role is to help you decide whether a trust is right for your situation and, if so, ensure it’s created and managed in a way that gives you total confidence in its purpose and effect.
Our Legal Services for Trusts
Every family is different, and so is every trust. That’s why we offer a full range of trust-related legal services designed to support you at every stage, whether you’re setting up a new arrangement, managing an existing one, or facing difficulties as a trustee or beneficiary.
Our experienced trust solicitors will take time to understand your specific concerns and goals, offering practical, tailored advice with empathy and discretion.
Creating a Trust is often a key part of planning for the future, whether you’re looking to provide for loved ones, manage inheritance tax, or protect your estate from future risks. We’ll guide you through every step of the process, from choosing the right type of trust to drafting the legal documents and ensuring your intentions are clearly set out. We’ll also advise on who to appoint as trustees, how to fund the trust, and how it fits alongside your will and wider estate planning.
Managing a trust brings legal responsibilities that can sometimes feel overwhelming. Trustees must act in the best interests of the beneficiaries and comply with a wide range of duties. This includes maintaining accurate accounts, registering with HMRC, making tax returns and taking investment decisions. Our team offers Trust Administration Services to support trustees in fulfilling those obligations confidently and correctly, helping avoid disputes or accidental breaches of trust.
Discretionary trusts offer maximum flexibility, allowing trustees to decide how and when to distribute income or capital to beneficiaries. This can be especially useful where family needs are uncertain or likely to change over time, such as when a child has additional needs, or where you want to protect assets from unforeseen future risks. Our Discretionary Trust Solicitors will help you understand how they work, and whether they’re the right option for your circumstances.
Constructive trusts can arise when someone has a legal right to a share in property, even if their name isn’t on the title, for instance, if they’ve contributed financially to a home. These situations often emerge after relationship breakdowns and can lead to complex legal disputes. If you believe you may have a beneficial interest in a property or are defending such a claim, our expert solicitors can advise you on your rights and the most appropriate course of action.
In some situations, a trust may no longer meet the needs it was intended to serve. It may be possible to alter or “vary” the terms of a trust to reflect changing circumstances, for example, to help a beneficiary access funds earlier than originally planned, or to respond to tax law changes. Our solicitors will assess whether a variation is possible and guide you through the legal process, including obtaining the required consents or court approval where necessary.
Unfortunately, even the most carefully planned trust can sometimes give rise to disagreements, whether between trustees, between trustees and beneficiaries, or with third parties. Our Trust Disputes Solicitors regularly advise clients on all aspects of trust disputes, including claims of mismanagement, disputes over entitlements, or allegations of undue influence or lack of capacity. We understand how sensitive these issues can be and will work with you to resolve matters as constructively and efficiently as possible, whether through negotiation, mediation or litigation.

Your Trust questions answered
Trusts are commonly associated with high-value estates, but they can be useful for people in a wide range of financial situations. The benefits of a trust, such as safeguarding assets, planning for care, or supporting vulnerable loved ones, are often more about protection and control than wealth alone. At Lanyon Bowdler, we regularly advise clients from all walks of life, and we tailor our recommendations to suit each person’s specific goals, regardless of the size of their estate.
A trustee is responsible for managing the assets placed within a trust in line with the terms set out by the person who created it. This role involves a high degree of responsibility and accountability, often requiring financial oversight, legal compliance, and careful decision-making. When appointing a trustee, it’s important to consider not only someone’s trustworthiness, but also their ability to act impartially, understand complicated financial matters, and dedicate the necessary time to fulfil the role effectively. In some cases, appointing a professional trustee can offer added reassurance and continuity.
It’s not uncommon for trustees to hold differing views, especially when making sensitive decisions. Disputes can usually be resolved through careful discussion and mediation, but if disagreements become entrenched or impact the effective administration of the trust, involving a solicitor may be necessary. Our team can provide support to help resolve trustee disputes amicably and, where needed, guide you through the legal steps required to resolve more serious disagreements.
Whether a trust can be varied depends largely on the type of trust and how it was established. Some trusts are more flexible than others, and in certain cases, the courts or all beneficiaries may need to agree to a change. Trust variations might be needed due to changing family circumstances, tax considerations, or the evolving needs of beneficiaries. If you are considering altering a trust, it’s crucial to seek legal advice to ensure any changes are made lawfully and in a way that protects all parties involved.
Trust taxation can be complicated, and the rules vary depending on the type of trust and how it’s structured. Trustees may be responsible for paying income tax, capital gains tax, or inheritance tax on behalf of the trust. Understanding your obligations is essential to avoid unexpected liabilities and ensure compliance with HMRC regulations. We work closely with clients and financial advisers to ensure trust taxation is managed properly and efficiently, in line with the latest legislation.
Yes, it’s possible to place your home into a trust for someone else, either during your lifetime or through your will. This can be a useful way to protect the property and ensure it’s passed on in line with your wishes. However, it’s important to be aware of the legal and tax consequences involved, particularly if you continue to live in the home or want to retain control. Local authorities may view this as ‘deliberate deprivation’ if they believe the trust was set up to avoid paying for care, which can have serious implications. We’ll help you understand the full legal picture so you can make a decision that’s right for you.
That depends on the terms of the trust. In many cases, the trust is activated when the person who created it dies, and the appointed trustees take over responsibility for the assets. If a beneficiary of the trust dies, their interest may pass to someone else, end completely, or be redistributed among other beneficiaries, all depending on how the trust was drafted. We can help you understand how a particular trust operates, and how it may evolve as life changes.
