Personal Injury Solicitors & Personal Injury Claims.

Our Personal Injury Solicitors are experts at obtaining financial compensation and care-packages required by the injured and the innocent when accidents happen.

We all hope it won’t happen to us, but our lawyers should be contacted immediately if you or a family member sustain an injury. If you have suffered because of an accident that was not your fault, or suffering from an industrial disease, it’s vital to talk to a Personal Injury Claim expert about your options.

Alternatively, if your spouse, partner or dependent has been injured or died as a result of an injury, you may be entitled to compensation. It’s an incredibly difficult time and while a legal claim might not be at the top of your priority list, we can support you through the process to see you are justly and fully compensated.

The Personal Injury Solicitors at Lanyon Bowdler is regarded as one of the highest performing Injury Claim teams in the Midlands, but more importantly, it’s made up of legal professionals with compassion and integrity. Our award-winning Injury Solicitors (headed by partner – Dawn Humphries) are approachable, friendly and devoted to using their expertise to ensure the best chances of recovery for injured people and in securing the highest possible injury compensation claims settlements.

We know the areas of loss suffered by victims may not always be spotted by less specialised lawyers, and we work with medical experts, as well as barristers, who are leaders in their field. We can offer support for No Win No Fee personal injury claims, whether you have suffered a minor injury or illness, or are claiming for life-changing accidents.

With membership of the Law Society Personal Injury Panel, Headway – the brain injury association’s Personal Injury Solicitors List, and the Association of Personal Injury Lawyers Corporate Accreditation, we offer highly specialised and experienced teams.

Our team is also included on the Spinal Injuries Association’s (SIA) approved list of personal injury solicitors.

Acted for a claimant who was injured during the course of his employment after falling down a stairwell void. This resulted in him sustaining life changing brain injury involving 47 fractures to the right temporal bone and organic injury to the frontal lobe.  Awaiting a pathways meeting and case is still ongoing.

Acting for a claimant who had worked at the same company for 18 years and sustained stress-related injuries. This matter is of significant importance to the client, as he thought he had a job for life with the company, before being forced out, also medical evidence indicates it is unlikely he will be able to return to an employed role, though he has recently set up his own small business.

What are Personal Injury Claims?

Personal Injury Claims are the legal process through which those injured in an accident can claim compensation. This includes a variety of circumstances, and you could be eligible for compensation for any accident that caused you an injury, and was caused by the negligence of a third party.

Negligence is an action, or lack thereof, that one could reasonably foresee would result in an injury. This constitutes a breach of the duty of care which is owed to you at work, in public places, and in many other circumstances.

It can be complicated to prove the negligence of a third party caused your injury. Our expert Personal Injury Solicitors have years of experience supporting claimants through the Personal Injury Claim process, and can help you gather the evidence you need to have a strong case against someone who caused you harm. Contact Lanyon Bowdler today to find out what your next steps are.

Your Personal Injury Claims Questions Answered

When should I start a personal injury compensation claim?

If you have suffered a personal injury, your first priority will always be to focus on your health, and recovering to the fullest. Starting a claim may not be the first thought on your mind. However, you may wish to pursue compensation for a personal injury at a later date, and might wonder whether your case is still valid some time after the accident.

The general rule for Personal Injury Claims in the UK is that they are valid for up to three years from the date of the accident. This is the time claimants have to formally begin their claim, and receiving advice before this deadline is not enough.

There are, however, a number of circumstances that may affect this time limit.

Firstly, if the extent of your injuries was not fully evident at the time of the accident, but is only diagnosed at a later date, you may bring a claim for personal injury up to three years from the date of knowledge rather than the date of the accident.

In cases in which a child injury claim is brought forward, the limit only applies to the child once they reach the age of 18 – meaning they may bring their injury claim, with a litigation friend, up to their 21st birthday.

Those who lack mental capacity under the Mental Health Act 1983 will only be subject to the time limit from the day their mental incapacity is removed.

If the claim is made in regards to an injury resulting in a fatality, then the three year time limit will begin on the date of the death, and not the date of the original accident.

Injuries sustained in a criminal incident must be claimed for within two years of the incident. This also applies to child injuries, which are under the same limit of two years, regardless of the age of the child. Injuries sustained on an aeroplane or ship are also usually subject to the shorter two year time limit for personal injury compensation.

It should be noted that these time limits could be subject to changes, and the court may amend or extend your time limit depending on the circumstances of your accident or injury.

What types of personal injury claims can we help with?

We have experience in handling a wide range of claims such as:

How much compensation could I receive for my personal injury claim?

Personal Injury Compensation amounts are calculated very carefully, considering not only your injuries, but also the wider repercussions of the accident on your quality of life, career, and personal life.

The amount of compensation you may receive is generally divided into two main categories:

General Damages

General damages in personal injury claims are awarded to compensate victims for the pain and suffering caused by an accident. These may include any compensation for long-term disability, disfigurement, and mental trauma.

The amounts can be complicated to calculate, which is why the English and Welsh legal systems have devised a collection of guidelines called the Judicial College Guidelines. These represent a standard starting point for your solicitor to calculate an appropriate amount of compensation you may be entitled to based on your injuries.

Special Damages

Special damages are calculated based on actual financial losses you may have incurred because of the accident. This includes both out-of-pocket expenses, such as medical and travel costs, and projected loss of future income because of a reduced ability to work. If you are left with a disability following the accident, you may also be entitled to be compensated for any adaptation you had to make to your home or vehicle.

What is Personal Injury?

Personal Injury is a term used to define an injury sustained by an individual’s body or mind. This is opposed to damages to property. It is commonly used in legal cases in which a tort lawsuit is brought from a claimant against another person or entity considered responsible for an injury, whether through negligence or misconduct.

The regulations regarding personal injuries, and the relative compensation claims, are a complex area of the law, as it can be difficult to prove the negligence of a third party in some cases. Generally, if someone can be considered to reasonably owe you a duty of care, they will be liable to compensate you for your injuries.

Our Personal Injury Compensation Solicitors at Lanyon Bowdler have an incredible level of expertise, and can guide you through the most complex of cases. We will fight for you with our deep knowledge of the law, and excellent customer service.

Contact Lanyon Bowdler’s Personal Injury Solicitors

You can drop into our offices during working hours. No appointment is needed, just call in. Most of our offices have disabled access and convenient parking. We can also arrange a home or hospital visit where clients have sustained serious injuries or where they affect your mobility, even if only temporarily.
