Agricultural Dispute Claims

Dealing with disputes in the agriculture sector can be stressful and time-consuming. However, as NFU legal panel members, our specialist team of agricultural solicitors, armed with many years of experience dealing with disputes within this industry, can help remove that stress.

If you are an NFU member and the dispute relates to your farming/growing business, you will be entitled to a 12.5% discount on our normal hourly rate. We can often offer a fixed fee to deal with all or part of the dispute. If you also subscribe to the NFU Legal Assistance Scheme, a grant may be available to cover part of the costs (subject to the terms and conditions of the scheme).

Types of agricultural disputes

Examples of the kinds of disputes we are well equipped to deal with include:

  • Shareholder disputes in the business, including disputes concerning promises made about inheriting the farm.
  • Agricultural tenancy disputes.
  • Property related disputes (e.g. rights of way, boundaries)
  • Nuisance claims (e.g. complaints about noise or smells)
  • Contract disputes (e.g. dispute over milk contracts)
  • Defective product claims (e.g. defective animal feed causing illness, seed failing to germinate, diseased seed)
  • Business disputes and legal disputes (e.g. poor advice by agronomists, solicitors or accountants, negligent veterinary services)
  • Will disputes (e.g. dispute about the validity of wills, or whether the will makes adequate provision for dependents)
  • Debt recovery (our specialist debt recovery team has an excellent track record in recovering payment from debtors)

Examples of the type of cases we handle:

  • RPA appeals.
  • Recovery of money from company directors personally when a herd of pigs was sold in breach of a debenture.
  • Recovery of compensation following supply of mite-infested horse feed.
  • Recovery of compensation for death of dairy cows and loss of milk yield following supply of defective feed.
  • Recovery of compensation when OSR seed failed to germinate.
  • Recovery of compensation when failure of neighbouring landowner to repair fence led to delayed turnout of cattle (with increased housing costs).
  • Successful appeals against RPA claims to recover overpayment of SPS money.
  • Claim by a stepson for an interest in the farm due to promises made to him, including an injunction to prevent surrender of a tenancy, and settling associated partnership dispute.

Our approach to dispute resolution

We provide expert guidance from the outset to help you understand the options open to you, the cost of dealing with the dispute, and the likely outcome. This enables you to decide how best to use your time and money in relation to the dispute. This need not involve going to trial; the vast majority of disputes never get that far. We look at the best options for trying to achieve a good outcome for you, which may involve negotiation, settlement meetings, or commercial mediation.

The specialist agricultural solicitors here at Lanyon Bowdler are based across the firm's offices in Shrewsbury, Bromyard, Ludlow, Oswestry and Telford, so are well-placed to work with clients across Shropshire, Herefordshire, Wales and beyond.
