Personal Injury Claims: Encouraging Victims to Access the Justice They Deserve.

The Association of Personal Injury Lawyers (APIL) has recently released its Third Annual Report within which it includes statistics which are suggestive that whilst more people are being injured, there are fewer claims, meaning that fewer injury victims go on to access justice.

The report also shares that opinion polling in Opinium in August 2024 advised one in five adults said they had sustained an injury, and 41% of those had not claimed compensation.

I find these statistics concerning and would encourage anyone who has been injured through the negligence of another, to consider making a claim for compensation to access the justice they deserve.

Here at Lanyon Bowdler our Personal Injury Team offers a free interview, and we will chat with you about your accident for as long as you need. This means someone can attend a meeting where they will be provided with up front and clear information as to how a claim works, what is involved in making a claim, what rehabilitation may be available to support them to get the best recovery possible from their injuries, and, importantly, gaining a clear understanding as to how legal costs work.

I have worked in personal injury law with Lanyon Bowdler for the last 29 years, and I know that no one personal injury claim is ever the same. For instance, if 53 people were injured in the same bus accident, each with the same injuries, all their claims would be quite different. This is because every client is an individual person and their responses to the impact of a trauma, and how they cope with a recovery from an injury, is personal and individual to them; any personal injury lawyer working with an injured person should ensure they respect and understand that, and they need to look after the individual as they follow the process of making a claim, whilst trying to juggle the trauma of recovering from an accident.

I always tell all my new clients that “I will be their friend” for however long their claim takes, and I genuinely mean this. I listen carefully to every client, and I respect the reaction to their accident. No client should ever be made to feel their injury is insignificant as all accidents, however minor they may seem, have the potential to have an impact upon an individual.

In my first meeting with a potential client, whether that be for an hour or more, I will take time to listen to what has happened, what the impact has been and I will then take time to explain the process of a claim, detailing what will be expected from someone wishing to seek compensation, as well as explaining what the options are in relation to legal costs. None of this information is hidden, and we are completely open about how costs are calculated and what element of costs a client may have to cover from their compensation.

I am disappointed to note that such a high number of people are not taking steps to access the justice they deserve and I would urge anyone who is thinking about making a claim to contact us here at Lanyon Bowdler to find out more.

Our awards and accolades.
