How we handle professional negligence claims

Lanyon Bowdler’s lawyers put your best interests first when pursuing claims of professional negligence. Where a positive outcome presents itself, we will aim to secure this for you.

In cases where litigation cannot be avoided, we offer representation in court and will build the strongest possible case to recover damages, losses and compensation awards.

We recommend alternative dispute resolution in cases where it is possible to negotiate a settlement out of court, including mediation for professional negligence claims where an agreement can be reached without litigation.

 

Establishing grounds to claim

In order to pursue a claim of professional negligence, we must first establish that you have sound reasons to bring a claim against the respondent.

Some of the questions we might ask to do this include:

  • Can you demonstrate a specific financial loss or reputational harm?
  • Is it clear that this occurred due to the actions or advice of the respondent?
  • Would another competent professional have given different advice?

Not all losses are avoidable, even with good advice. However, if a professional fails to advise you of potential risks and you lose income or business value as a result, negligence may have occurred.

Equally, a failure to act can be a form of negligence. Therefore, if a professional acting on your behalf misses a deadline or otherwise harms your business due to their inactivity, you may have grounds for a claim.

It is important to be aware of the time limits that apply when bringing a professional negligence claim. In general, you must commence your claim within the following time frames:

No more than six years after the negligent act occurred.
No more than three years after you became aware of the negligence.

Why attempt ADR?

Alternative dispute resolution, or ADR, is a good way to resolve cases more quickly, with lower costs and less harm to reputations. In many cases, following an out of court settlement, the parties continue their business relationship without long-term problems.

By making use of ADR, you can negotiate privately or appoint a commercial mediator to recommend a particular way to proceed. The respondent may be much more willing to consider your claim if they can see you want to avoid going to court.

Even if your claim ends in litigation, the courts may take a more positive view if you can demonstrate to them that you attempted ADR and that the respondent was not cooperative.

Lanyon Bowdler can take care of your case from start to finish. We can write to the respondent to notify them of your claim, negotiate with them on your behalf and, in cases where a settlement cannot be reached, we can litigate for you in court.
