How much compensation can I get for an amputation?

The amount of compensation for an amputation is largely determined by General Damages — the element of your claim that compensates for Pain, Suffering, and Loss of Amenities (PSLA). Awards are guided by the Judicial College Guidelines, which set ranges based on the severity and location of the amputation.

Typical Amputation Compensation Ranges:

  • Fingers and Thumb: minimum  £10,550 (for a little finger) to £110,750 (for index finger and another).
  • Hands: £133,810 (for one hand) to £245,900 (for both).
  • Arms: £177,360 (for one arm, before elbow) to £366,100 (for both).
  • Feet: £102,470 (for one foot) to £245,900 (for both).
  • Legs: £119,570 (for one, below knee) to £344,150 (for both).

Your Amputation questions answered

What is amputation?

Amputation is where a limb is removed either through surgery or traumatic injury. Medical teams can sometimes decide that amputation is necessary to protect life; to stop infection such as gangrene or to control the spread of cancer. Surgical amputations are on the increase in the UK as a direct result of increases in Type 2 diabetes.

In 2022, there were over 19,000 amputations handled by the NHS, with 7,005 resulting from diabetes-related issues. This indicates an increase of almost 1,000 diabetes-related amputations from the prior year, and 2,000 from the same figure from 2012.

What can lead to amputation?

Amputation can happen from many different causes. If you have suffered from loss of limb caused by the negligence of a third party, you will likely be eligible to make a claim. The two main reasons claimants suffer amputations are below.

Traumatic Amputation

Losing a limb as a result of an accident is always going to be a challenging time. Whether it’s because you have been involved in a road traffic accident, or accident in the workplace, or even as a result of medical complications following what may first seem like only a minor injury. Time will be required for you to adjust and mend.

Loss of Limb from Medical Negligence

Losing a limb due to medical negligence either through treatment being delivered without due care and attention or because of a serious complication during surgery leaves a long-term impact often as devastating as for those that have suffered limb loss through a traumatic injury following an accident. What are the causes of traumatic injury amputation?

Injuries that lead to limb loss or amputation can, unfortunately, be caused during accidents involving a variety of environments. Road accidents & accidents at work tend to be amongst the most likely causes of amputation.

Limb loss may occur during the accident itself or a limb could be removed by doctors in surgery following the accident. Sometimes amputation may be the only option to ‘save life’ if a patient has suffered a severe burn, excessive blood loss or a limb has been badly crushed.

Traumatic limb loss is often caused in accidents where the injured person is not at fault in any way. They are often caused by the fault or negligence of others. Road traffic accidents and industrial (work accidents) result in the highest levels of amputation in the UK’s adult population, whereas accidents around the home are the biggest single cause of children suffering amputation. Amputation of the leg below the knee is the most common form of amputation.

Accidents at work and especially those in industrial settings where heavy machinery is involved can be caused by machinery not being regularly monitored and maintained by employers and also where staff have received inadequate training or where protective measures are not put in place for the workforce.
