What is Residential Property Conveyancing?
Simply put, residential property conveyancing is the handling of all the legal and administrative work involved in transferring a property from one person’s ownership to another.
The process generally takes place in three parts and our role as your lawyer will depend on whether you are buying and/or selling a property.
Once the sale on a property is agreed upon, a large amount of information needs to be gathered and verified. This includes the identities of all parties involved, the financial position of the prospective buyer and whether there are any debts or charges held against the property for sale, including any outstanding mortgage.
The title deed for the property will be required along with the Energy Performance Certificate and the Property Information Form, containing details such as boundary responsibilities, property access, planning permissions, fixtures and fittings and utility providers.
It is at this stage that the relevant searches will be carried out on the property such as water, environmental, telecommunications, railway and Local Authority searches. These are a legal requirement for any property being bought with a mortgage and help to verify the information provided by the seller. The buyer’s survey will also be carried out by the lender to confirm the property’s value.
Once all the relevant checks have been carried out and the paperwork completed, the contracts will be prepared by the lawyers on both sides. Any issues will be resolved before contracts are signed and, once these are exchanged, the sale becomes legally binding and a date is set for completion.
The amount of time between the exchange of contracts and completion can vary and can be anything from a few days to a couple of weeks so that the final paperwork can be prepared and the funds for the purchase put in place.
These must be made available at least one working day before the completion date.
On the day of completion, all fees associated with the transaction will be settled and any outstanding mortgage paid before any money left over is transferred to the seller.
At this stage, the sale is complete, and the new owner is registered with the Land Registry. Any reference to the previous owner and mortgage will also be removed.
