Am I Eligible to Make a Whiplash Compensation Claim?

You may be eligible to make a whiplash claim if you have suffered the injury in a road traffic accident that was caused by someone else’s negligence. This applies whether you were a driver, passenger, cyclist, motorcyclist, or even a pedestrian at the time of the accident.

In England and Wales, a claim for a whiplash injury only, if valued under £5,000, has to be dealt with under the Government’s Official Injury Claim (OIC) portal without the assistance of a solicitor. It is always best to check with us as to whether or not your claim would need to be dealt with via the OIC portal. However, if your injuries are more severe, include other injuries as well as whiplash, your case is complicated, or you are claiming additional losses such as lost earnings or rehabilitation costs, you may be entitled to pursue a higher-value claim through a solicitor.

Even if you are partly at fault for the accident, you may still be able to claim compensation on a reduced basis. The key factors are proving that another party owed you a duty of care, that duty was breached, and you suffered injury as a result.

What is a whiplash injury?

Whiplash is a soft tissue injury to the neck, caused by the rapid back-and-forth motion of the head during a sudden impact, such as a road traffic collision. Symptoms can include pain, stiffness, headaches, dizziness, and reduced mobility. While some cases resolve within weeks, others can lead to long-term discomfort and require ongoing treatment.

 

 

 

How much compensation could I receive for whiplash?

Since the 2021 reforms, most whiplash claims under £5,000 are managed through the Official Injury Claim portal. Compensation is based on a fixed tariff and depends on how long your symptoms last. However, if your injury is more severe or you have other losses such as lost earnings, rehabilitation costs, or psychological harm, your claim may exceed this threshold. In those cases, our solicitors can help you pursue a higher-value settlement.

 

 

 

How long do I have to make a whiplash claim?

In most cases, you have three years from the date of the accident to start your claim. If the claim is for a child, the three-year limit begins from their 18th birthday. In certain cases involving lack of mental capacity, time limits may be extended.

 

 

Do I need medical evidence to make a whiplash claim?

Yes. Independent medical evidence is required to support all whiplash claims. Even if you have already seen a GP or attended hospital, a medical report from an accredited expert will be arranged to document your injuries and their likely recovery time.

 

 

Can I still make a whiplash claim if the other driver was uninsured or left the scene?

Yes. Claims can be made through the Motor Insurers’ Bureau (MIB), which compensates victims of uninsured or untraced drivers. Our solicitors are experienced in handling these claims and can guide you through the process.

 

 

Will my whiplash injury case go to court?

Most whiplash claims are settled without the need for a court hearing. Court proceedings are only necessary if liability is disputed or a fair settlement cannot be agreed.
