Legal Advice for Settling Family Related Disputes Out of Court

Legal issues affecting your family such as divorce and separation can be incredibly stressful, particularly when disputes have to be settled through the court.

At Lanyon Bowdler, we encourage a collaborative approach to resolving issues, frequently helping clients to work through disagreements and disputes through negotiation and discussion, with an exceptional level of success.

Our clients are regularly able to resolve family law matters amicably and without the need for lengthy court proceedings, reducing the stress for everyone involved and helping to keep legal costs down.

About non-court dispute resolutions

Settling family-related matters in a court of law is one of the major worries that many of our clients share. They are often concerned about the pressure and formality of such a situation but under the guidance of our lawyers, many of our clients avoid such proceedings entirely and reach a resolution in a collaborative way, minimising conflict between the opposing parties.

Any agreement must be approved and put into a court order to ensure its legality and fairness to everyone involved, but you will not need to attend.

We firmly believe that reaching an agreement without court involvement is the most positive option as it encourages communication on both sides and allows you to have an input into the outcome.

There are a number of ways to work through the disputes you may be facing following your divorce or separation. Common issues that arise often relate to living and access arrangements for children, division of assets and finances settlements, all of which can be successfully resolved through the following:

Collaborative Law

At Lanyon Bowdler, we are experts in collaborative law and can help you with all aspects of negotiating an agreement away from the court with regard to your family and finances.

We will be by your side to represent and support you at all face-to-face meetings with your former partner and will provide you with ongoing legal advice as we work towards reaching an amicable agreement that you are happy with and that works for everyone, particularly your children. This is a welcome alternative to having a decision made by a judge and allows you instead to be actively involved in finding a solution. It is also an important step for collaborative working and communication in the future, if you and your partner are co-parenting.

Mediation

Similar to collaborative law in its approach, mediation involves an impartial third party, who will be present in all meetings to work with both parties to find an agreement. We can direct you to fully qualified and highly experienced mediators and we can draw up the formal agreement, following the negotiation stage, to ensure that your interests are protected and that everything is legally binding.

Arbitration

A fully qualified third party will be appointed to make a final decision on your particular family law dispute, if you cannot come to an agreement between yourselves.

We are well-connected across the industry and can secure the services of one of the region’s leading arbitrators, if this is a route you wish to pursue. We will be on hand to draw up the legal paperwork and formalise any decision that is made.

What are the benefits of out of court dispute resolution?

There are a number of advantages to solving your family law dispute away from the courts including:

  • Keeping costs down
