Neurological Injury Compensation Solicitors

If a medical procedure has resulted in an injury to your brain, spinal cord or the peripheral nerves in your legs, arms or muscles, you could be eligible to make a claim for surgery negligence compensation.

The team of specialist clinical and medical negligence solicitors here at Lanyon Bowdler are highly experienced and are experts in their field. They will be able to help you through every stage of the process - starting with whether you have a claim for compensation.

What is Neurology?

The medical field of neurology covers a wide range of disorders including:

  • Epilepsy and seizures
  • Tumours and traumatic brain injuries
  • Disorders of mind and intellect such as Alzheimer’s, forms of dementia and problems relating to memory
  • Headaches and migraines
  • Facial pain
  • Stroke and Transient Ischaemic attacks (TIA)
  • Blackouts and dizziness
  • Balance disorders
  • Disorders affecting movement such as Parkinson’s disease and tremors
  • Tingling, pins and needles and numbness
  • Inflammatory disorders of the nervous system such as Multiple Sclerosis
  • Sleep disorders
  • Weakness in muscles, cramps and pains

Most neurologists will specialise in one or more of these types of disorders. Their work involves neurological examinations and observations to assess muscle strength and movement, sensation, balance and reflexes, speech and memory and other cognitive abilities.

There are a variety of diagnostic tests, including:

  • MRI/MRA (magnetic resonance imaging/ magnetic resonance angiography)
  • CAT (computed axial tomography) scan
  • Lumbar puncture (spinal tap)
  • EMG/NVC (electromyography/nerve conduction velocity)
  • EEG (electroencephalography)

The accuracy and reporting of these tests is essential in neurology, and an instance of medical negligence at the diagnostic stage can be devastating for the patient.

Making a Brain Injury Compensation Claim

Neurological injury to the brain or spine are some of the most devastating brain injury claims which the team of specialist lawyers here at Lanyon Bowdler have dealt with. Many of these clinical negligence claims arise from a failure to diagnose crucial conditions, which means neurologists have then either failed to administer the correct treatment or have carried out the wrong kind of treatment, with catastrophic consequences for the patient.

Previous brain trauma compensation cases undertaken by Lanyon Bowdler have included the following oversights from medical professionals:

  • Failure to diagnose a brain tumour.
  • Failing to test adequately and consequently misdiagnosing a subarachnoid haemorrhage, causing permanent brain damage.
  • Failure to diagnose and treat spinal conditions causing permanent incontinence and disability.
  • Failing to adequately manage medication for epilepsy.
  • Failure to manage multiple sclerosis causing exacerbation of disability.
  • Failure to identify and treat drug toxicity causing tremors and seizures leading to death.

The operations could have been negligently performed, or the treatment itself could have been wrong. Sometimes, a patient may not have provided 'informed consent' for a surgical procedure or course of treatment, and can subsequently claim that they would not have given their consent if they had been made fully aware of the risks involved.

The role of a clinical negligence solicitor when acting on behalf of an injured person is to establish the extent of the injury and how it was caused. So the lawyer must therefore involve the correct medical and ancillary experts to fully assess the injury at the earliest available opportunity, and will then work with them throughout the case.
